An Application to the State Planning Commission for a review of a decision not to proceed is an approved form for the purposes of section 110 of the Planning, Development and Infrastructure Act 2016.
The State Commission Assessment Panel (SCAP) may refuse an application that relates to restricted development without proceeding to make an assessment. This decision cannot be appealed to the Court; however, an applicant may seek a review of this decision by the Commission.
The Commission may, on a review, affirm the decision of SCAP or refer the matter back with a direction that the application be assessed.
There are no Court appeal rights against the Commissions review decision.
